Job Description

The Associate Director/Director of Intellectual Property will help build the Company`s global intellectual property portfolio through strategic planning and execution of patent preparation and prosecution. Partnering with in-house clients across multiple functional areas, she/he will build, maintain and defend the Company`s intellectual property interests. The Associate Director/Director of IP will develop in-depth expertise in particular areas of medicinal biology and provide guidance on patent law issues to business groups and scientists conducting research in those areas. The ideal candidate will prove integral and invaluable to the business as the Company continues to discover and explore innovative medicines and technologies to help patients. The role will report to the head of IP at Acceleron and will have high visibility throughout the organization.

What will you be doing?

Key Responsibilities Include: 

  • Provide IP counseling to in-house clients within Research & Development, Program Management, Manufacturing, Business Development and other functional areas through all phases of drug research, development and commercialization.
  • Prepare patent applications with a primary focus on the protection of inventions relating to biologic therapeutics.
  • Maintain a substantial and active prosecution docket of U.S. and foreign patent applications, including post-grant practices as they may arise with prosecution.
  • Provide IP counseling to support product lifecycle planning and develop strategies for enhancing exclusivity.
  • Manage collaboration patents and in-licensed patent portfolios, coordinating with partners and licensors to secure patent rights that will aid the Company’s business.
  • Conduct due diligence (e.g., freedom-to-operate, infringement and validity assessments).
  • Review and provide comments for agreements pertinent to areas of responsibility (e.g., drafts of collaboration research agreements, CDAs and MTAs).
  • Support intellectual property-related transactional and litigation work within areas of responsibility.

What are we looking for?

Ideal Experience/Education:  

  • 6-8 years of patent drafting and prosecution experience in the biotechnology field; ideally in both a law firm and a bio/pharmaceutical corporate setting.
  • Registration to practice before the U.S. Patent and Trademark Office.
  • An advanced degree in biological science (e.g., Biology, Biochemistry, Molecular Biology), is required; PhD is strongly favored.
  • Experience with Post-Grant Proceedings (e.g., PGR, IPR, Reexamination, and Oppositions) is preferred.
  • Experience with Trademark and Trade Secret protections is preferred.

Critical Competencies:

  • Ability to counsel in-house clients on complex IP issues and potential implications to current or future business strategies within the field of molecule/medicine development.
  • Ability to prosecute active and complex patent portfolios with respect to therapeutics in development or being commercialized.
  • Ability to work collaboratively with other Legal group members and with other functions (e.g., R&D, Commercial, Corporate and Business Development) in the organization, and successfully manage outside counsel; work effectively both in a team and independently.
  • Demonstrating strong knowledge of domestic and international laws, regulations and processes relating to patents.
  • Excellent analytical, organizational, and communication (written and verbal) skills; ability to effectively communicate complex IP issues and adapt to audiences with varying levels of legal fluency.
  • Ability to balance and prioritize multiple tasks, and to respond effectively to rapidly changing priorities and deadlines.

REBLOZYL is part of a global collaboration partnership with Bristol Myers Squibb. The Companies co-promote REBLOZYL in the United States and are also developing luspatercept for the treatment of anemia in patient populations of myelodysplastic syndromes, beta-thalassemia, and myelofibrosis.
